Tiffany Wins Restraining Order Against Jeweler

Tiffany & Co. won a temporary restraining order June 7 against a Michigan jewelry store it claims is selling counterfeit Tiffany rings on eBay.

The order stems from a lawsuit Tiffany filed against Diamond Ten and Dearborn, Mich.–based Ace Diamond Jewelry on June 2 for false advertising, trademark infringement, unfair or deceptive trade practices, and injunctive relief.

Tiffany’s filing claims that Diamond Ten and Ace Diamond Jewelry offered 22 rings for sale on eBay between Oct. 1, 2010, and June 2, 2011, and advertised those rings as authentic Tiffany products. The company purchased two of the rings and determined they were fake and marked with counterfeit Tiffany trademarks, it said.

According to the lawsuit, “Diamond Ten holds itself out in its advertising as being a division of Ace, or as an entity of which Ace is a division.”

The temporary restraining order, issued by the U.S. District Court, Eastern District of Michigan, Southern Division, will be in effect until the preliminary injunction hearing on June 13.

The defendants could not be reached for comment at press time.
