On Oct. 4, moissanite manufacturer Charles & Colvard announced that the U.S. Patent and Trademark Office upheld all claims under its patent No. 5,723,391.
The patent office reached that conclusion following an ex parte reexamination.
The government agency had been asked to review the patent by BetterThanDiamond.com, which claimed there were three “prior art” publications.
“This successful reconfirmation of the Company’s 391 Patent by the USPTO follows the determination by the Australian Patent Office earlier in May that the Company’s Australian patent is both novel and inventive when faced with a similar ex parte reexamination,” the company added.
