A California man is suing Nordstrom and
Groupon alleging a gift certificate he purchased through the social promotions
website expired too fast.
According to the claim,
Anthony Ferreira purchased a “Daily Deal” offer from Groupon in November 2010
for a Nordstrom Rack “groupon” gift certificate. He paid $25 for a gift
certificate redeemable for $50 worth of apparel, shoes, accessories, and other
retail products at Nordstrom Rack. The “groupon” gift certificate said it
expired Dec. 31, 2010.
Ferreira didn’t make a purchase before the
year ended, and on Jan. 21, he filed a lawsuit, claiming Groupon sells and
issues gift certificates with relatively brief expiration dates knowing
customers will not use the gift certificates in that period. Federal and
California state laws prohibit the sale and issuance of gift certificates with
expiration dates, the suit said.
Nordstrom’s lawyer could not be reached for
comment at press time.
