Company Sued Over Tiffany-Branded Snacks

If you enjoy Tiffany-branded snacks at your Fourth of July barbecue, one noted industry name won’t be too happy.

On May 9, Tiffany & Co. sued United Merchandise Wholesale, which markets Tiffany Hazelnut Wafers and Tiffany Chocolate Wafers, claiming the company’s use of the word “Tiffany” represents trademark infringement.

“Defendants are using the TIFFANY name to benefit from the recognition and goodwill of the TIFFANY Mark, to misappropriate the goodwill of the mark … and to deceive, confuse, and mislead consumers that their products derive from or are authorized by Tiffany,” said papers filed in the U.S. District Court for the Eastern district of New York.

The suit claims the the product’s manafucturer attempted to register trademarks for Tiffany Potato Snacks and other cookies, but withdrew the application when the noted retailer objected.

United Merchandise Wholesale and co-defendant IFCO have not filed a response at press time. UMW did not reply to a request from JCK for comment. A person who answered the phone said the suit was “finished.”
