CIRCA Files Trademark Lawsuit

CIRCA recently filed a federal lawsuit against a company
trading under the name Circa Auctions, after learning the company was using one
of its trademarks, according to a press release.

According to the release, the lawsuit was filed on Nov. 5 in the Federal Court of Canada against a company incorporated under the name
3805913 Canada Inc. and three of its principals including Kashif Khan, Ravi
Poddar, and Sampat Poddar.

In September 2010, attorneys for CIRCA INC. put the company on
notice of CIRCA INC.’s rights to the trademark in association with its
services. On Oct. 13, 2010, CIRCA INC. publicly stated via press release
that the company was using the CIRCA trademark without its prior knowledge,
consent, or authorization.

The lawsuit seeks an interim, interlocutory, and permanent
injunction against the defendants and includes a claim for punitive, aggravated, and exemplary damages.
