Continental Jewelry (USA) Inc. and Gramercy Jewelry Manufacturing Corp., the licensee and owner, respectively, of U.S. Patent No. Des. 411,134, settled their litigation against Isaac’s Fine Jewelry Inc. and Baroka Creations Inc. in March. Under terms of the settlement, Isaac’s Fine Jewelry Inc. and Baroka Creations Inc. agreed that U.S. Patent No. Des. 411,134 is valid and enforceable and that one of their jewelry settings infringed on the design claimed by the patent. Isaac’s and Baroka also agreed not to manufacture, use, sell, or offer for sale any jewelry items that embody the design claimed in the patent until it expires. The case was heard in the U.S. District Court for the Southern District of New York.
