Online consignment company The RealReal has been hit by a proposed class action suit after selling a cocktail ring that allegedly overstated its weight.
According to the complaint, filed Dec. 4 in Northern California federal court, plaintiff Gaby Basmadjian paid $982.62 to The RealReal for an 18k gold pavé diamond ring that was represented as having 2.1 cts. t.w. diamonds.
After getting it checked, a gemologist told Basmadjian that the ring contained only 1.2 cts. t.w. diamonds, according to the complaint.
That discrepancy, the suit argues, falls outside the accepted weight tolerances specified by the Federal Trade Commission (those require diamond weight be accurate to the last decimal place). Further, “there is no indication on the [item’s] description that the carat weight was approximated,” it charges.
The RealReal could not be reached for comment. However, it told CBS News: “The lawsuit is without merit and The RealReal will aggressively defend itself against these baseless claims.”
The suit seeks class action status, and wants to include in the class any RealReal customers who bought jewelry where the weight of gemstones listed on the site exceeds the true weight by more than 1/100th of a carat.
