Sterling Settles Suit Over Jane Seymour



Sterling Jewelers has settled a suit with the Fort Pierce, Fla.–based Five Dollar Store, which Sterling accused of copying designs from Seymour’s Open Hearts collection.

According to a consent judgment filed Sept. 29 in the United States District Court Northern District of Ohio, Eastern Division, the Five Dollar Store agreed that it distributed jewelry which copied Sterling’s Jane Seymour line, and that it had “no rights” to those designs.

The agreement enjoins the Five Dollar Store from producing any more copies, and said the store must immediately transfer any remaining copies to Sterling.

In addition, the company agreed to pay Sterling $1,400 in damages. The two sides agreed to bear their own attorney costs.

Five Dollar Store could not be reached for comment at press time.
