PhotoScribe Prevails in Lawsuit

-- JCK-Jewelers Circular Keystone, 5/1/2008

A judge ruled that PhotoScribe's diamond-inscription equipment, seen here, does not violate Lazare Kaplan's patents.

PhotoScribe Technologies, a manufacturer of equipment for laser-inscribing diamonds, won a patent-infringement lawsuit brought against it and the Gemological Institute of America by Lazare Kaplan International.

Following a two-week trial, a jury found that PhotoScribe and GIA do not infringe on any of the 10 patent claims asserted by Lazare Kaplan. Additionally, the jury invalidated one of the claims of Lazare Kaplan's patent.

This verdict resolves patent-infringement issues first initiated by Lazare Kaplan against PhotoScribe in May 2006 and against GIA in July 2007. Issues with respect to the enforceability of Lazare Kaplan's patents remain outstanding, PhotoScribe said.

GIA declined comment, and LKI did not respond to a request for comment.
