Mervis Diamond Importers Wins Lawsuit

A lawsuit filed by Mervis Diamond Importers, Rockville, Md., against Congressional Hotel Corp. claimed the developer breached its obligations to Mervis under a 2004 contract to lease more than 3,000 square feet of retail space attached to the then–Ramada Hotel. The suit accused CHC of failing to build out and provide the space.
The Montgomery County Circuit Court in Maryland held that CHC is liable to Mervis for damages and interest of more than $3.4 million, Mervis said in a statement. The Court also awarded Mervis its legal fees, bringing the total close to $4.3 million, Mervis said.

Did Mervis ever move into the space, or did the developer not reimburse them for their build out?
