W.B. David Case Against De Beers Appealed



It seems that defrocked sightholder W.B. David’s 7-year-old case against De Beers may not yet be over.

On Oct. 31, Angela Tese-Milner, trustee of the estate of now-bankrupt W.B. David & Co., filed an appeal to the ruling by a federal court judge tossing the case out of court.

On Sept. 29, judge Kimba Wood ruled the case’s anti-trust issues were covered in the $300 million class action settlement against De Beers, while some of the original allegations fall outside the statute of limitations. (Update on the De Beers antitrust settlement.)

The appeal asks the court to reconsider whether the court erred in those judgments, as well as its decision to vacate De Beers’ original default in the case.
